Fly Free For Health Terms and Conditions

These terms and conditions govern the contractual relationship between Meggaholics Pte Ltd (Megg) and FlyFreeForHealth (FFFH) members. The terms and conditions should be read carefully, particularly as they include limitations and exclusions of liability in favour of Megg and Partners.

Interpretation

"Active Members" means members who have ordered a health program every 12 months of membership

 

"Travel Incentive" means any incentives offered by Megg in conjunction with its partners in the area of air ticket rebate, air miles, hotel/resort etc. The nature and form of the incentive will be determined by Megg in its sole discretion.

 

“Lifestyle Incentive” means any incentives offered by Megg in conjunction with its partners in the area of dinning, spa, party passes etc. The nature and form of the incentive will be determined by Megg in its sole discretion.

 

"Member" means any person who is a member of the FFFH programme.

 

"Partners" means businesses with whom Megg has made arrangements for members to benefit from either via incentives or other arrangement. A full list of Partners is available at www.FlyFreeForHealth.com.

 

“Treatment Country” means the country where medical programme is carried out.

 

General Conditions

1. www.FlyFreeForHealth.com (FFFH) is managed and operated by Megg.

 

2. FFFH is open to individuals aged two or above. In respect of minors (individuals aged under 18 years), parental or legal guardian consent is required to join FFFH. Membership is not available to corporations or other legal entities. Membership is accepted at the sole discretion of Megg.

 

3. Members will receive limited air ticket rebate and other designated travel and lifestyle incentive at sole discretion of Megg subject to terms and conditions to the benefit of Megg and its Partners. Active members will be issued with a membership ID for more comprehensive incentive and loyalty programme.

 

4. Membership in FFFH and membership ID are not transferable and may only be used by the member. Membership ID remain the property of Megg and will be deleted upon termination of membership or otherwise upon request. Misuse of membership ID or programme benefits may result in termination or suspension of membership, or withdrawal of benefits.

 

5. Megg reserves the right to modify FFFH structure, benefits and other features, including these terms and conditions, or to terminate FFFH at any time. Although Megg will use reasonable effort to notify members of material changes to FFFH and/or to these terms and conditions, it is the responsibility of members to keep themselves up-to-date in respect of the FFFH programme and these terms and conditions. Any use of FFFH programme by a member will be deemed as acceptance of any amendment. Megg and/or Partners will not be liable for loss or damage resulting from any amendment to FFFH or to these terms and conditions. Megg will also not be liable to any loss or damage by service resulting from its Partners.

 

6. Upon becoming an active member of FFFH, members will receive a permanent membership ID. A fee will be charged for replacing lost ID.

 

7. Members under the age of 18 years will not receive any promotional material.

 

Enrolment

 

1. Potential members can apply online at www.FlyFreeForHealth.com or enrol through completing designated enrolment form, and can start to choose a suitable health programme to obtain air ticket rebate and other incentives.

2. Enrolment forms are not valid and will not be processed unless completed correctly and hard copy applications are signed by the applicant. Upon successful registration of membership, members will receive a welcome email from Megg detailing instructions on how to notify Megg of the confirmed booking of FFFH’s Health Programme. It is the onus of the members to select the appropriate health programme and liases directly with the health service provider in costs and time of appointment. Megg is not liable for any change in expectation, schedule, costs, complications, side effects and outcome of the health programmes provided by the health service provider. Megg and the content at FFFH does not represent the medical opinion of any of our health service provider.

 

3. Members will not receive a permanent membership ID until they have become active.

 

4. Membership of FFFH is at the sole discretion of Megg and Megg may refuse membership to any applicant.

 

Membership Termination

 

1. An FFFH membership account which has not recorded any activity for a period of 36 months will be suspended and closed without notice.

 

2. Members may terminate their membership at any time by giving written notice to Megg and deleting their membership ID.

 

3. Megg may forthwith terminate the membership of a member and the right of a member to use his/her membership card if a member commits misconduct or fraud, misuses FFFH programme benefits and awards, or fails to follow these terms and conditions. In such circumstances, Megg shall simultaneously cancel all Incentives/Credit points/Rebate (if any) of the member.

 

4. Megg may also terminate the membership of a member at its complete discretion and in such circumstances will provide the member with three to six months notice of termination. Upon expiry of the notice period, all unused Incentives/Credit points/Rebate will be cancelled.

 

5. Termination of membership for whatever reason shall be without prejudice to the accrued rights and remedies of Megg and its Partners and the member as at the date of termination.

 

6. Upon the death of a member the membership account will be closed and all outstanding Incentive/Credits points/Rebate will be cancelled.

 

7. If a member has obtained any Incentive/Credit points/Rebate for himself/herself or others through fraud, dishonesty or deceit then the member shall without limitation be liable to Megg or Partners for the full price of the Incentives/Credit Points/Rebate or other products or services obtained together with all costs and damages incurred or suffered by Megg as a result thereof.

 

8. In the event of termination of membership a member must forthwith delete his membership ID.

 

Air Ticket Rebate

 

1. To receive Air Ticket Rebate, members must select and complete one of FFFH’s health programme and present the full receipt of the health programme together with the air ticket and passport to our designated agent or location to claim for the air ticket rebate. The air ticket rebate will be dispensed to the member within 72 hours in the treatment country or otherwise specified upon receipt and verification of relevant documentation. Megg is not responsible for failure of dispensing air ticket rebate if members fail to communicate to Megg on arrival schedule and Health programme booking details in accordance to the Welcome Email from FFFH. Megg is also not responsible for any changes of appointment due to any reason arising from the members or the health service provider.

 

2. The value of the Air Ticket rebate is pegged at S$100 inclusive of bank changes(if any). Any changes of the rebate and the actual amount of the rebate will be reflected in the Welcome Email upon registration of FFFH membership.

 

3. All health programmes listed at FFFH are eligible for Air Ticket Rebate if the spending at our medical service provider is more than S$2000 per programme transaction in one receipt unless otherwise stated.

4. For promotions restricted to a particular market, residency is determined by the member's preferred mailing address as registered with FFFH.

 

5. Air Ticket Rebate will only be officially dispensed upon the acceptance of a FFFH membership application and approval of membership status.

 

6. Air Ticket Rebate is not transferable and receipts cannot be aggregated to become a single transaction. Receipt from different health programs and different health service providers cannot be combined as a single transaction.

 

7. Air Ticket Rebate is not applicable for any promotional packages at FFFH.

 

Travel & Lifestyle Incentives

 

1. Travel & Lifestyle Incentives will be offered to members only after verification of documentations and proof of eligibility of Air Ticket Rebate. The nature and form of the incentives will be in the sole discretions of Megg. The nature of the incentives and the list of partners will be available at www.FlyFreeForHealth.com and its related communication platform like email newletters, sms notifications etc. The incentives may take the form of a sms vouchers and it is important that your mobile phone number entered in the registration form is accurate and on roaming service at your treatment country. Photo ID will be required together with your sms vouchers for redemption.

 

2. The nature (including the validity) and form of the incentive and incentive communication/information delivery may change from time to time without advance notice subject to market conditions like stock availability etc. Megg is not liable for any changes of the offering at the point of redemption managed by our partners.

 

3. Each incentive is not transferable and incentives can not be accumulated or bartered for other offerings. The validity of each incentive cannot be extended. The partners may apply additional terms and conditions in respect of the availability and eligilibilty of the incentive. All transactions are non-refundable and non-reversible. Megg may accord different incentive schemes to different members at its sole discretion unless otherwise specified. Incentives are applicable to any promotional package. The nature of incentive may vary from treatment country to treatment country.

4. Incentives of product/service in nature are manufactured or provided on behalf of Partners and other third parties. Megg is neither the supplier nor manufacturer of any product related incentive and excludes all liability in respect of (i) the quality, merchantability or fitness for purpose of any product-related incentive; (ii) the quality of any service-related incentive. In particular, Megg does not warrant that any service-related award will be provided with reasonable care and skill.

 

5. Megg is not responsible or liable in any way for any warranty provided with an incentive. Members are advised to contact Partner(s) or suppliers directly should there be any query or dispute concerning the product warranty and maintenance.

 

6. In case of dispute relating to incentive, without prejudice to clauses 4, 5 of Travel and Lifestyle Incentives, the sole liability of Megg in respect of any defect in or failure of any product or service related incentive or for any loss, injury or damage attributable, directly or indirectly, thereto is limited to the period of 12 months from receipt of the incentive and limited to making good the defect or failure by (at Megg’s option) replacing the product or procuring the performance of the service or crediting the member with the other equivalent incentive.

 

Data Privacy and Miscellaneous

 

1. The personal data supplied by members is required for the operation of FFFH and related loyalty programmes. This includes Health Programme tracking and management and rebate/incentive issuance. Personal data may also be used for ongoing research, programme development and to communicate news and information to members. Failure by members to provide or keep up-to-date required data may result in Megg being unable to offer FFFH membership and associated benefits. In such cases, membership may be terminated.

 

2. All information is managed in accordance with the Singapore Personal Data (Privacy) Ordinance and Megg's Data Privacy Policy which can be found at www.FlyFreeForHealth.com. Such Data Privacy Policy is deemed incorporated into the contract between Megg and a member. Information may be passed to supplier and Partner organisations to facilitate communications of news and information to members. Members have the right not to receive such communication from either Megg, or other Partner organisations.

 

3. Members have the right to request to review and correct any personal data held by Megg. In such circumstances, members should complete a data access request form available from Megg. An administration fee may be charged for the processing of these requests.

 

4. Members are responsible for registering and keeping Megg up-to-date on their correct communication/postal address. Megg is not responsible for any loss as a result of a member's failure to notify of a change in address.

 

5. Active Members will be issued with a confidential Personal Identification Number (PIN). Member must ensure that this number is not disclosed to any unauthorised parties. Megg cannot be held liable for the consequences of any unauthorised disclosure of the PIN by members or unauthorised use of the PIN, including unauthorised redemption of incentives.

 

6. Members may incur a tax liability or disclosure obligation through use of FFFH. Megg reserves the right to provide any tax authorities with full details of any members accrual and redemption of incentives, on request of a tax authority. Megg excludes all liability for cooperating with tax authorities in this manner.

 

7. Rebate, incentive and credit points(if any) and all rights of title to and property remains with Megg at all times and never passes to the member.

 

8. The failure by Megg to exercise or enforce any right herein contained shall not be deemed to be a waiver thereof nor shall it affect Megg's entitlement to take any subsequent action in respect of that right or of any other right.

 

9. Should any provision of these terms and conditions be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions of these terms and conditions. All provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

 

10. These terms and conditions constitute the entire agreement and understanding of Megg and a Member in respect of FFFH and supersede all prior written or oral representations, agreements or understandings between them relating to the subject matter of these terms and conditions (including any misrepresentation made by Megg), other than any fraudulent misrepresentation made by a party to induce the other party to enter into these terms and conditions.

Exclusion and Limitation of Liability

 

1. Megg and/or Partners shall not be liable to any member or Nominee or companion for any indirect or consequential loss, damage or expense of any kind whatsoever arising out of or in connection with the FFFH programme the provision or the refusal to provide any benefits, and awards and the use of awards, whether such loss, damage or expense is caused by negligence or otherwise, and whether Megg and/or Partners have any control over the circumstances giving rise to the claim or not.

 

2. Subject to clause 1 of "Exclusion and Limitation of Liability" above and any applicable limitations under the Warsaw Convention or under the carrier conditions of travel, Megg and/or Partners liability in contract, tort or otherwise with respect to any claim arising in respect of acts or omissions under the FFFH programme including provision and use of awards, shall be limited to re-crediting the value of the incentive/ Credits points offered to or redeemed by the member respectively in connection with which the matter arises.

 

3. Megg will endeavour to ensure the availability of products and services provided by Partners but will not be liable for any loss arising from the failure by Partners to provide such products and services. Where a member uses the services provided by a Partner, their terms and conditions will apply and Megg will not be liable for any loss.

 

4. For the avoidance of any doubt, nothing in these conditions shall exclude liability for death or personal injury caused by negligence. All terms expressed or implied by statute or otherwise on the part of Megg and/or Partners are hereby excluded to the fullest extent permitted by law.

 

Law and Jurisdiction

 

1. These terms and conditions and the relationship between Megg and each member are governed by Singapore law. By using the programme each member submits to the non-exclusive jurisdiction of the Singapore courts.

 

2. If this English version of the terms and conditions does not conform to other language versions, the English version shall prevail. In case of dispute, Megg reserves the right to final decision.
